great story peter, didn't know that magna carter stuff and I bloody well should have done.
It brings back memories of getting stopped by law enforcement on burke street.
just as a contrast to arrest stories , this week was school holidays and I did shows midweek, on the first day I got hasseld from these drunk scousers (people from liverpool), I was chatting to one of the local police the next morning , I mentioned I was worried about them coming back as I may have antagonised them somewhat by taking their cider and pouring it away
In the afternoon when I did shows , the police didn't walk past the show as usual, they stayed to watch out for me , I didn't ask them to but it felt good when they showed up and certainly a far cry from being told to leave town by them.

Debbie Robinson and Gary Animal know a little about the British precedent, but it is very vague.

If the truth is to be known, it is a totally nefarious point of law. It is, in one way, very fragile but, in another, it is as scary as shit to some constitutions. Most lawyers just won't go near it. Simon really should have chosen to perform on the streets rather than at the bar, but hey?

I would not rely on this at all. You would be laughed out of court in Europe and the US.

PS, Lovely to hear from you, AJ. Lots of love to you and your's from me, Bev, Ulla, Pro et al.
      Every-one should watch their drawers!

Just got arrested for the first time last night. I was on South St in Philly PA. I've played there before, about a month ago and my crowd flooded the street. Cops shut me down and just told me to run along and I got a bit sassy. Said something like "Well it looks like I'm getting shut down but I'm sure there's nothing these good officers can do if you'd like to tip my hat some more while I pack up." No problems. Last night I was just starting and only had about six or seven people in my crowd. Cops came and told me to cut it out and I slowed down the music as if I were a dieing record player. Didn't really sass them or anything. Then they told my crowd to move along and told me to put my hands on the hood of the green jeep that was behind me. They threw me in the pady wagon and went through my backpack. I heard one of them say "Whoa look he got a ten!". They were making all sorts of cracks and spun Belluh (my drumset) around on the tip of her hi hat stand to try an piss me off. I sung "what shall we do with a drunken sailor" to occupy myself as I was being hauled down to the station and tried to get out of my cuffs to see if I'd be any good as an escape artist which only resulted in blisters... : /. I got charged with "obstructing the highway. My court date is Friday the 13th which sucks cuz I have to be in Atlanta on the 15th and they won't let me push the date back. Turns out they stole that ten and my mini leatherman knife which was a gift from my Dad and I use it 24/7. I suppose I'm really lucky they didn't take all the money that was in my bag. I hadn't performed much that day but I counted it out this smorning and had about $200. All in all it was kinda a good time. I've never been arrested before so it was interesting. Just wish I didn't have to deal with all this bullshit that has followed.... I can't really stop thinking about the look on all those pedestrians faces when they saw a guy with a drum on his back getting arrested. Perhpas something is wrong with me but I'm still laughing about how obsured my life and this whole situation is.

Teen Plans To Fight Ticket For Playing Hacky Sack

          Ericka Lewis
          Reporting

(CBS4) BOULDER, Colo. Boulder police called a recent ticket a crackdown on illegal activity on the Pearl Street Mall but one family said it went too far.

Of all the things Kallen Ford could be doing to get in trouble, the Boulder High School senior didn't think playing hacky sack was one of them.

On Tuesday, Ford said he was playing one of his favorite pastimes when he was approached by an officer.

"I was pretty surprised," Ford said. "The cop walked up behind me and had me sit down and took the hacky sack and he said it was evidence in a crime."

Ford was issued a ticket for releasing projectiles on the mall which is a crime that carries a $250 fine.

"$250, I said I don't have that kind of money," said Margaret Pilcher, Ford's mom.

She was shocked so she paid a visit to the officer who ticketed her son.

"I said were talking a hackie sack, I said I don't see that as a projectile and he goes 'I made my best judgment,'" Pilcher said.

The officer originally intended to give Ford a warning but said the teenager had a bad attitude. He said Ford kicked the hacky sack away and that's what led to the steep fine.

Ford disagreed with the officer's description of his behavior and plans to tell a judge next week when he fights the ticket in court.

          end

God bless the Peoples Republic of Boulder!
