    South Street Seaport Dismissing Performers?!?

    Dear Fellow Performers,

My name is Josh, I have been performing at the South Street Seaport since 1992. I have worked annually as a street performer and advocate for the "Street Performer Program".

In 2005 I led a non-union petition against an imposed $500 fee. We won! In 2005 I spent hundreds of hours writing letters and applying for sponsors for the South Street Seaport 2005 "Busker's Fare" and was not paid for this project. We got it!

The festival was held in June 2005 sponsored by LOMA and part of the River To River Festival.

This week I was dismissed from the program by The South Street Seaport Managers while working in my designated location at the proper time, after a discussion with a disrespectful waiting new act.

I am quite worried that this "out with the old, in with the new..." is a precursor to a dismantling of the program. I need to spread the word to performers from the past few years who were dismissed form the program. I have talked with several acts who have been dismissed, and would like to see about a class action suit.

Please forward this to fellow buskers. I am back to honest american busking work in the subways and parks.

    I am contacting local attorneys.

Thanks for your support over the years, especially Jim Smirk, and...

    Mr. Stephen Baird.

Sincerely, Josh, Busker's Hall of Fame 2005.

Josh, Sorry to hear about all your troubles. It seems like NYC is kicking your ass this year. Have you made living arrangements yet?

              What to Do? Sue?

              Dear Irina,

Gee, I talked with Sasha a few weeks ago. Thanks.

He is suing from his false arrest in NYC a few years ago.

Too busy. The aftermath of now being without a home in my hometown in unacceptable. Later.

              Sincerely, Josh.

I do not know if you can sue them - as this is private property, not public space like Central Park, and you were not illegally arrested like Sasha, but you should consult with an attorney - there may be a way to get them, or at least to threaten them with lawsuit and negative publicity and mediate the conflict. It will be an unfair business practice, not civil rights case, I guess...Why did they dismiss you? You've been with them forever! We lost our business there when they got temporary tattoo concession - it was a conflict of interest, we were killing their business and they paid rent for the booth, so Seaport kicked out all face-painters...If you want to discuss this in private - send me an e-mail,. I would get over it and focus on new sources of income and different pitches: you will probably not be invited to return. If you led a petition against a proposed fee, are you really surprised by this? Most corporations kind of like getting money. When sucking on the corporate teat, either avoid biting, or prepare to be removed.

Excuse me if I don't sound too sympathetic to your situation, but this is a no-brainer on wheels.

I would organize a buskers march on White House. They do have an area there, assigned for free speach, we should go there and demand our rights with a big fat copy of the Constitution. I think we will win just because Obama will like the chance to play a "good papa of the nation" and give the jesters their rights, he has 'real problems" to deal with and can use some comic relief and the fame of being a 'street performers liberator"... What I am talking about is 'feel good" performance/parade/political protest wich will just attract a lot of attention because of creative element. Hey, if you need something to do - you could do somthing like putting this together, sign me in and I will mail you a money order for te non-profit. I started a new thread on 'pitches' - it started like a wild idea, but I am feeling some really strong vibe about it, I am just not much of an organizer....but I will sure participate and support something like that!

                        Such Kind Words...

                        Well thanks for writing.

No, I've been working there for 17 YEARS annually.

Read my blog, if you care to know more.

Irina, is that a reference to war protester Cindy Sheehan from 2005?

Sweet of you to write, I have no time for another organizational effort these days.

                        No, really, thank you.

                        Sincerely, Josh
